Terms of Use
Effective 7 October 2026
The short version. You make a promise to yourself and choose a stake for each missed day. Keep it and nothing is charged. Miss a day and the stake you chose is charged to your card, and Swear It keeps it. Every rule is on the promise before you swear it, you can appeal a charge within 14 days, a person will review it if you ask, and you can take days off. Making promises needs a subscription, which renews until you cancel it in the App Store or Google Play. You must be 18 or older.
1. This agreement
These terms are an agreement between you and Nalla Sai Abhiram, an individual who trades as Swear It ("Swear It", "we") and provides the Swear It app and this website. By making an account or using the app you agree to them and to our Privacy Policy. If you don't agree, don't use the app.
2. Who can use Swear It
You must be at least 18 years old and able to enter a binding contract where you live. Where the law requires it, we confirm that with the age range your phone's app store reports. One account per person. Keep your sign-in to yourself: you're responsible for what happens under your account.
3. What Swear It is
Swear It is a commitment tool. You decide what you promise, how it's proved, the deadline, and what a miss costs. Whether a promise is kept depends only on what you do, never on chance and never on anyone else. Swear It is not a game of chance, a bet, a savings or investment product, and a stake is not a deposit: no money is taken or held when you make a promise.
4. Promises and stakes
- The stake is the amount you agree to pay Swear It each time you miss that promise. You choose it: from $5 to $100 a miss. No missed day costs more than $100.
- When it's charged. A day is missed when its deadline (plus any grace you set) passes without proof that counts. The stake is charged to your card at that moment. If you sent proof in time and it was turned down after the deadline, the charge waits two hours so you can send better proof or appeal first.
- Your authorization. When you add a card and swear a promise, you authorize Swear It to charge that card, through our payment processor, the stake shown on that promise each time you miss it, under the rules shown on it, for as long as the promise runs. These charges are made when you are not using the app, without asking you again each time: that is the point of a stake. The amount of each charge depends on the promise and is never more than the stake and limits shown on it. You are notified of every charge when it is made, with the reason, and every charge is listed in the app's Money tab. You can remove your card whenever no promise is running and nothing is owed. Your card details are held by the processor, never by us.
- Cards. You can use a credit or debit card, Apple Pay or Google Pay. Prepaid cards aren't accepted. Nothing is charged when you add a card. Charges appear on your statement as SWEAR IT, sometimes with our payment processor's name in front of it, in the currency shown on your promise (US dollars at launch).
- Where it goes. Swear It keeps a missed stake as a fee you agreed to. It isn't passed to anyone else, and it isn't refundable except as section 6 says.
- Limits that protect you. No missed day costs more than $100, and you are never charged more than $200 in one week (Monday to Sunday, in your time zone) across all your promises; past that a miss still counts, but nothing is charged for it. After three misses in a row on one promise, further misses on it aren't charged until you keep a day again. If you set a lower weekly cap on a promise, it holds. A promise shows every one of its rules before you swear it.
- Other terms you can choose for a promise, each shown on it before you swear: a stake that grows with misses in a row (never above $100 for one missed day), a price for lateness or for a shortfall, a charge given back after a run of kept days, surprise checks.
- If your card declines, the charge stays owed and is tried again, and you can't swear a new promise until it's paid. If your bank needs you to approve a charge, the app asks you to.
- Changing a promise. Making it harder takes effect at once. Making it easier, or ending it early, is a request decided against the rule you wrote for yourself, or takes effect after a week's notice. For ten minutes after swearing you can undo a promise as if it was never made, unless you turned that off.
- Days off. Three days off a month are yours for the asking when asked for ahead of time. More, or a day off on the day itself, is a request decided against your rule.
- Locks you set on yourself (for example on ending promises or changing your rules) hold until they open the way you chose. That is what they are for.
5. Proof and how it's checked
- You prove a day the way the promise says: a photo, a video, a screenshot, a check-in at a place, a timer, a figure from Apple Health or Health Connect, a connected app, a voice note, writing, a friend who vouches, or your own word.
- Proof that needs judging is checked automatically, by software that uses artificial intelligence (models from OpenAI), against what the promise says counts. Figures measured by your phone or a connected app are checked against the target you set. You get the verdict and the reason.
- Send honest proof. Proof must be yours, from the day it's for, and true. Faking proof, or tampering with the app to get around a check, breaks these terms.
- Automated checking can be wrong. That is what appeals are for, and why a person will review a decision when you ask (section 6).
- Check-ins at a place are for places such as a gym, a library or an office. Don't save a place that provides health care in person (a clinic, a hospital, a pharmacy, a therapist's or dentist's office) as a check-in place: prove those promises another way.
6. Appeals, late proof and refunds
- You can appeal a missed day within 14 days, saying what happened, with pictures, a video or a voice note if you like. Appeals are decided against the rule for appeals you wrote. If an appeal is upheld, the day counts and its charge is refunded to your card.
- Proof sent late, within 14 days of the day it was for, counts if it shows the day was kept, and its charge is refunded.
- If you chose "hard" for a promise, it takes no appeals. That is your choice, shown before you swear it.
- A person, when you ask. Appeals are decided automatically, against your rule. If you believe an automated decision that led to a charge was wrong, you can ask a person on our team to review it: open the charge in the Money tab and choose "Ask a person to review", within 60 days of the charge. You can say what you think went wrong. If they agree, the charge is refunded. This applies to every promise, including "hard" ones, where the review looks only at whether the check itself was mistaken. We answer within 30 days.
- Refunds go back to the card that was charged, and usually arrive within 5 to 10 business days.
- If we charge you in error, tell us (Settings, Report a problem) and we will put it right.
- Nothing here limits refund rights the law gives you where you live.
7. The subscription (Swear It Plus)
- Swearing a new promise needs Swear It Plus: a yearly or a monthly subscription. The price, any free trial, and what you'll be charged are shown before you buy. Promises you've already sworn keep running whatever happens to the subscription, and misses on them are still charged.
- Payment is taken by Apple or Google through your store account. The subscription renews automatically at the end of each period, at the price shown, unless you cancel at least 24 hours before the period ends. A free trial turns into the paid plan unless you cancel before it ends; the app reminds you two days before, if its notifications are on.
- Cancel or change it in your App Store or Google Play subscription settings (Settings, Swear It Plus, Manage subscription takes you there). Deleting the app or your account does not cancel it.
- Refunds for subscriptions are handled by Apple or Google under their policies.
- The subscription and your stakes are separate. The subscription pays for the service; a stake is charged only when you miss.
- If we change the price, the store will tell you beforehand and you can cancel.
8. What you may not do
- Make promises that require harm to yourself or anyone else, illegal acts, starving yourself or other dangerous extremes, or that depend on chance or on another person's behaviour. The app refuses these and we may end ones that slip through, without charge.
- Share promise templates that are abusive, hateful, sexual, or that identify another person. Shared templates are screened and can be reported; we remove what breaks this rule.
- Use somebody else's account or card, dispute charges with your bank that you agreed to here instead of appealing, or use the app to launder money or commit fraud.
- Reverse-engineer, overload or interfere with the service, or use the API or connectors beyond what their permissions allow.
9. Your health and safety come first
Swear It is not medical, psychological, nutritional or financial advice, and the coach is an automated system that uses artificial intelligence, not a person and not a professional. Talk to a doctor before starting an exercise, diet or sleep plan. Never put yourself at risk to keep a promise or save a stake. If you're ill, injured or something serious comes up, take a day off or appeal: that is why those exist. Choose a stake that motivates you, never one you can't afford. If a promise is making things worse, end it.
10. Your content
Your promises, proof, messages and other content stay yours. You give us permission to store and process them to run the service for you, as the Privacy Policy describes. If you share a promise as a template, you let other users see and copy its name, the way it's proved and its schedule. Feedback you send us may be used to improve the app without owing you anything.
11. Connected apps and other services
If you connect another app (for example GitHub, Duolingo or RescueTime), sign in with Apple or Google, or link Telegram, you also accept that service's own terms, and you let us read the figures a promise needs from it. We aren't responsible for those services, and if one is down or wrong, appeal the day.
12. Reminders and availability
Reminders, alarms, widgets and the coach's check-ins are there to help; they can be delayed or silenced by your phone, and your deadlines hold whether or not one arrives. We work to keep Swear It running but can't promise it will never be interrupted. If an outage on our side stops you proving a day, appeal it and say so; we refund charges our own failures caused.
13. Ending things
You can delete your account at any time in Settings. Your running promises end that day and nothing more is charged for them; charges already made stay made. We may suspend or close an account that breaks these terms, fakes proof, or is used for fraud, and we'll tell you why unless the law forbids it. Sections that by their nature should survive (charges already made, liability, disputes) do.
14. Disclaimers
Swear It is provided "as is" and "as available". To the extent the law allows, we make no warranties beyond those written here, including of merchantability, fitness for a particular purpose and non-infringement. We don't promise that Swear It will make you keep any promise, or that automated checking will always be right.
15. Limit of liability
To the extent the law allows, Swear It and its people are not liable for indirect, incidental, special, consequential or punitive losses, or for lost profits or data. Our total liability to you for anything connected with Swear It is limited to the greater of what you paid us in the twelve months before the claim or US $100. Nothing in these terms limits liability that can't be limited by law, or rights you have as a consumer where you live.
16. Law and disputes
These terms are governed by the laws of India, and disputes go to the courts of Visakhapatnam, Andhra Pradesh, unless the consumer law where you live gives you the right to bring a claim at home. Please write to us first: most things are settled by an email.
17. Changes
We may update these terms. If a change matters, we'll tell you in the app before it takes effect. A change never alters the rules of a promise you've already sworn against you. If you keep using Swear It after a change takes effect, you accept it.
18. If you got the app from the App Store
These terms are between you and Swear It, not Apple, and Apple isn't responsible for the app or its content. Your licence is to use the app on Apple devices you own or control, as the App Store's usage rules allow. Apple has no obligation to maintain or support the app. If the app fails to meet a warranty that applies, you can tell Apple and Apple will refund what you paid for the app, if anything; beyond that, Apple has no warranty obligation. Claims about the app (product liability, legal compliance, consumer protection, intellectual property) are ours to handle, not Apple's. You confirm you're not in a country under a US embargo or on a US list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
